Terms AND CONDITIONS
By scheduling an appointment with Precision Mechanical of Western New York ("we", "us", or "our"), you agree to be bound by the following Terms and Conditions (“Terms”). Please read these Terms carefully before booking an appointment. If you do not agree with these Terms, do not use our services.
1. Appointment Scheduling
1.1 Booking Process: Appointments for HVAC and refrigeration services can be scheduled online by selecting an available time slot and providing all required information, including contact details and service location.
1.2 Appointment Duration: Each appointment is scheduled for a duration of one (1) hour unless otherwise specified. Additional time may incur extra charges, subject to our standard rates.
1.3 Service Area: Services are provided within a 20-mile radius of the 14760 ZIP code (Olean, NY). Appointments requested outside this service area may be subject to additional travel fees or may not be available, at our sole discretion.
2. Diagnostic Fees and Payments
2.1 Non-Refundable Diagnostic Fees: A diagnostic fee is required to schedule an appointment. This fee covers the technician’s time and expertise to assess the issue with your HVAC or refrigeration system. The diagnostic fee is non-refundable, regardless of whether you proceed with repairs or additional services.
2.2 Payment Terms: Full payment for the diagnostic fee is due at the time of booking. Additional service fees, if applicable, will be communicated after the diagnostic visit and must be paid upon completion of the service unless otherwise agreed.
2.3 Missed Appointments: Appointments are valid only for the scheduled date and time. If you fail to be present at the service location during the scheduled time or cancel with less than 24 hours’ notice, the diagnostic fee and any other prepaid fees are non-refundable, and you will forfeit the appointment. Rescheduling may be subject to availability and additional fees.
3. Cancellations and Rescheduling
3.1 Cancellation Policy: You may cancel or reschedule an appointment by contacting us at service@pmwny.com or by calling 716-379-3169 at least 24 hours before the scheduled appointment time. Cancellations made less than 24 hours in advance will result in the forfeiture of the diagnostic fee.
3.2 Rescheduling: Rescheduling is subject to availability. If you reschedule an appointment, the original diagnostic fee may be applied to the new appointment, provided the request is made at least 24 hours in advance.
4. Service Limitations and Expectations
4.1 Scope of Services: Services provided through PMWNY include diagnostic assessments, repairs, maintenance, and other HVAC and refrigeration services. We do not guarantee specific outcomes or repairs beyond what is determined feasible by our technicians.
4.2 Access Requirements: You must provide safe and unobstructed access to the HVAC or refrigeration system at the scheduled time. Failure to provide access may result in a missed appointment, with no refund of the diagnostic fee.
4.3 Safety and Compliance: All services are performed in accordance with industry standards and applicable local, state, and federal regulations. You are responsible for ensuring that your property complies with any necessary codes or permits required for HVAC or refrigeration work.
5. Liability and Warranties
5.1 Limitation of Liability: To the fullest extent permitted by law, PMWNY shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services, including but not limited to property damage, loss of use, or business interruption. Our liability is limited to the amount paid for the service.
5.2 Warranties: All services are warranted to be performed in a professional and workmanlike manner. Specific warranties on parts or labor, if any, will be provided in writing at the time of service. No additional warranties, express or implied, are provided unless explicitly stated.
5.3 Customer Equipment: You are responsible for ensuring that your HVAC or refrigeration equipment is in a safe condition for our technicians to service. We are not liable for damage to equipment that is outdated, improperly maintained, or otherwise defective prior to our service.
6. Customer Responsibilities
6.1 Accurate Information: You must provide accurate and complete information when scheduling an appointment, including the service address, contact details, and a description of the issue. We are not responsible for delays or issues caused by inaccurate or incomplete information.
6.2 Property Conditions: You must ensure that the service location is safe, accessible, and free from hazards (e.g., pets, debris, or unsafe conditions). We reserve the right to refuse service if the location is deemed unsafe or inaccessible.
7. Privacy and Data
7.1 Data Collection: By using PMWNY, you consent to the collection and use of your personal information as outlined in our Privacy Policy. We collect information such as your name, contact details, and service address to facilitate appointment scheduling and service delivery.
7.2 Data Security: We take reasonable measures to protect your data but are not liable for breaches caused by third parties or events beyond our control.
8. Termination of Services
We reserve the right to refuse or terminate service at our discretion, including but not limited to situations involving unsafe conditions, abusive behavior, or failure to comply with these Terms. In such cases, the diagnostic fee and any prepaid fees are non-refundable.
9. Force Majeure
PMWNY is not liable for delays or failure to perform services due to events beyond our control, including but not limited to inclement weather, natural disasters, or equipment failures.
10. Governing Law and Dispute Resolution
10.1 Governing Law: These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles.
10.2 Dispute Resolution: Any disputes arising from these Terms or our services shall be resolved through negotiation in good faith. If a resolution cannot be reached, disputes will be subject to the exclusive jurisdiction of the courts in Cattaraugus County, New York.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on pmwny.com and are effective upon posting. Your continued use of our services constitutes acceptance of the updated Terms.
